The controversy in this case lies in a very narrow compass and it is pointed out by the petitioner that he is a permanent Stage Carriage Permit Holder on the Banda-Baberu routs. The UPSRTC is plying its vehicles without obtaining any permit from the Regional Transport Authority concerned or the State Transport Authority which is illegal. In view of the provisions of Section 66 of the Motor Vehicles Act, 1988 no person is permitted to ply the vehicle without having a legal permit to ply the vehicles on a particular route.
In view thereof after hearing learned counsel for the petitioner Shri W.H.Khan and Shri Jamal Ali and Shri R.A. Gaur for the respondent no.3 and the learned Standing Counsel for all other respondents, we dispose of the Writ Petition directing the Corporation not to touch any part of the route involved herein unless it has a valid permit issued under the provisions of Section 66 of the Motor Vehicles Act, 1988 either by the Regional Transport Authority or State Transport Authority. The respondent no.2 is directed to ensure the compliance of this order.
