Heard the learned counsel for the petitioner.

This petition has been directed against a revisional order whereby the court below has dismissed the petitioner's revision. The revision was directed against an order of the trial court passed on temporary injunction matter directing issue of notice to the defendant/respondent and fixing a date for its disposal. Obviously such revision is not maintainable in view of several case law of this Court as well as of Hon'ble Apex Court out of which a latest decision given by me in Writ Petition No. 6547 of 2006, Om Prakash and others Vs. Ashok Kumar and others, decided on 2.2.2006.

Obviously this petition does not appear to have any force and is hereby dismissed.

It is however, observed that as per the learned counsel 29th of this month is fixed for disposal of temporary injunction application in which counter and rejoinder affidavits have been exchanged. In this view of the matter, the trial court will take up the temporary injunction application on that date and pass final orders on the same, in case the parties cooperate in the hearing of injunction. However, no unnecessary adjournment shall be allowed.
