Heard learned counsel for the applicants and learned A.G.A. for the State.
Notice on behalf of O.P. no.1 has been accepted by the learned A.G.A.
Issue notice to O.P. no. 2 by Registered Post.
I also heard the learned counsel for the applicant as well as the learned A.G.A. on the prayer of stay.
It appears on perusal of the record that the Investigating Officer hasdsubmitted a charge sheet against father-in-law, mother-in-law, brother-in-law of the bride and no charge sheet had been submitted against the applicants who are sister-in-law and Devar of the bride. They were subsequently summoned on the basis of the statement of P.W.1 under section 319 Cr.P.C.
Hence, I pass an order that till the next date of listing, operation of the order dated 17.5.2005 passed in case no. 7567 of 2004, State Vs. Rajesh Singh and others, by the Addl. Chief Metropolitan Magistrate, IXth, Kanpur Nagar summoning the present applicants shall remain stayed. However, the case against the remaining accused shall proceed in accordance with law.
