Heard learned counsel for the appellants and learned A.G.A on the prayer for bail.
The deceased had received as many as seven injuries . According to the opinion of Doctor, those injuries were caused by sharp edged weapon. The role assigned to the present appells in FIR is of causing the injuries by Lathi.
considering all the facts and circumstances of the case, we are of the view that appellants should be released on bail . Let appellants Suresh and Sampat convicted under sections 302/34, IPC sentenced thereunder in Sessions Trial no. 123 of 1999 ( State Vs. Jagmohan & others) be released on bail during the pendency of appeal on their executing a personal bond and furnishing two reliable sureties each in the like amount to the satisfaction of the Chief Judicial Magistrate, Allahabad .
The C.J.M, Allahabad , shall send photocopies of personal and surety bonds executed and furnished by and on behalf of the accused- appellants to this Court soon thereafter.
