Heard learned counsel for the applicant.

The applicant alleges non-compliance of the order dated 23.8.2005. It is strange that the applicant has filed the contempt application but has no where stated specifically that the order dated 23.8.2005 has not been complied by the opposite party. There is no such averment either in the affidavit or in the prayer.

Further I find from the affidavit that the order of the Court dated 23.8.2005 has been complied by the opposite party by issuance of an order dated 19.11.2005.

In view of the aforesaid, the contempt application is dismissed summarily.
