The deceased government employee Shri Hanumant Singh was admittedly the elder brother of the petitioner's father (Tau), the petitioner is, therefore, not covered within the definition of family member as contemplated under Section 2(c) of the U.P. Recruitment of Dependents of  Government Servants (Dying in Harness) Rules, 1974.  He is not entitled for any compassionate appointment as claimed in the present writ petition.

Writ petition is accordingly dismissed.
