Learned counsel for the appellant submits that the case of the appellant is distinguishable to the case of co-accused Sonu @ Gajendra against whom specific role of assault is attributed and the appellant was not arrested on the spot. The case of appellant, Shera @ Sher Singh is similar to that of co-accused Sonu alias Sonu Dhimar, who has been released on bail by this Court.
Considering the facts and circumstances of the case, appellant Shera @ Sher Singh convicted in S.T. No.704 of 2005(corresponding S.T no.703 of 2005), shall be released on bail during the pendency of the appeal on his executing a personal bond and on furnishing two sureties each in the like amount to the satisfaction of the court concerned.
Till further orders, realization of fine shall also remain stayed.
