Heard learned counsel for the petitioner and perused the impugned order dated 18.1.2006. It appears that Original Suit No. 49 of 2006 (Zila Sahkari Federation, Ltd. Allahabad vs. Nathu Singh and others) was filed in the court of Civil Judge (S.D.), Allahabad. The plaintiff moved an application for temporary injunction also.
Learned Judge, prima facie, found no ground to issue exparte injunction. He, therefore, issued notices to the defendants fixing 30.1.2006 for disposal.
Learned counsel for the petitioner informs that now disposal of the injunction application is fixed for 16.2.2006. The court below is, therefore, directed to dispose of the application of the petitioner for temporary injunction as expeditiously as possible. Besides, the petitioner has got a remedy against the impugned order by way of filing a revision in the court of District Judge. Admittedly, no revision is pending in the Court of District Judge, Allahabad.
With the aforesaid observations, the writ petition stands disposed of.
