Since the petitioner wanted to withdraw the writ petition yesterday i.e. 13.2.2006 by mentioning the matter, we directed him to serve a notice upon the learned counsel appearing for the private respondent. Again the matter was mentioned at the time of rising of the Court when the learned counsel for the respondent is not present. Today, when the matter is called, learned counsel for the respondent is present. He states that he cannot stand in the way in conncection with the prayer made by the petitioner.
In such circumstances, the writ petition is dismissed for non-prosecution.
The interim order, if any, stands vacated.
No order is passed as to costs.
