According to the petitioner, the partner of the petitioner had fallen ill and during the period of illness, the Manager of the petitioner committed the irregularity alleged in respect of which the petitioner lodged a First Information Report against the Manager. When the show cause notice was given to the petitioner, the petitioner fairly conceded about the irregularities and gave the aforesaid explanation. The licence of the Fair Price Shop of the petitioner has been cancelled on the ground that the responsibility of the irregularity by the Manager must be shared by the petitioner.
Having regard to the totality of facts, the nature of illness and the frank confession of the petitioner, we stay the operation of the impugned order dated 10.10.2005 till further orders.
