Heard learned counsel for the petitioner and learned counsel for caveator and perused the materials on record.
From perusal of order of Deputy Director of Consolidation, it is clear that contesting Opp.Parties were given Udan chak upto the stage of Settlement Officer Consolidation. Deputy Director of Consolidation by the impugned order allotted chak on the original holding of contesting opposite parties. It is also clear from the record that petitioner was also given chak on his original holding.
Learned counsel for the petitioner urged that some plots by the impugned order were given to petitioner but not on his original holding.
Considered the materials on record and also perused CH form 23, and the schedule attached with the impugned order of Deputy Director of Consolidation. It is clear that petitioner was given chak on his original holding by Deputy Director of Consolidation also taking other plots adjoining plots. The order passed by Deputy Director of Consolidation was in accordance with the provisions and principles laid down under section 19 of U.P. Consolidation of Holdings Act. There is no error of law apparent on the face of record.
Writ Petition is dismissed.
