I have heard the learned counsel for the petitioner and Sri Neeraj Tripathi who appears for the respondents.
The grievance of the petitioner is that the institution in question has been granted ''B' certificate, therefore, for the Sessions 2004-05, about 150 students have been given admission. Now the petitioner has prayed that for that purpose examination may be taken and the petitioner be permitted to hold the examination.
I have considered the submissions made on behalf of the petitioner. From the letter-dated 29.6.2005, it is clear that an inspection to that effect has been made and the matter has been referred to the Chancellor and the State Government has referred the matter to the University for consideration. No final order has been passed as yet; therefore, in my view, if any admission is made by the petitioner in anticipation that will not accrue any right to the petitioner as well as to the students. Unless and until the final certificate regarding the affiliation and the order of the Vice Chancellor is passed, no relief can be granted to the petitioner. Now it is open to the petitioner to approach respondent no.2 for his grievances and the concerned authority may consider the same.
The writ petition is disposed of accordingly.
