Ram Nath v. The Dy. Director Of Consolidation, Azamgarh & Others - WRIT - B No. 8134 of 2006 RD-AH 3398 (14 February 2006)
Heard learned counsel for the petitioner and learned Standing Counsel.
Learned counsel for petitioner urged that land in dispute is petitioner's original holding which was initially chak out, but on the objection filed by the petitioner, it was included in the consolidation proceedings and allotted to one Bodha, tenure holder, in lieu thereof, petitioner was allotted chak no. 615. He further urged that Ram Nath-petitioner has no concerned with the land in dispute. The revision filed by Ram Avadh should not have been entertained, as the revisionist was not an aggrieved party. Learned counsel for petitioner further urged that that petitioner has also filed an objection/application about maintainability of revision which is still pending.
This Court is of the view that revision as well as objection may be heard and decided at an early date in the facts of the case.
Accordingly, I direct Deputy Director of Consolidation concerned to hear and decide the revision along with objection filed by petitioner within two months from the date of presentation of a certified copy of this order.
