Against the order dated 1.2.2006 passed by the Recovery Officer, the petitioner has got alternative remedy for filing an appeal under the Recovery of Debt Dues to the Bank and Financial Institutions Act 1933. The grievance of the petitioner is that without auction and selling the property of the borrower, the property of the petitioner has been attached, who is a guarantor and without taking any steps for recovery of the amount from the actual borrower, the property of the petitioner is going to be sold out and the recovery has been directed. This order has been passed on 1.2.2006. In view of Section 30 of the Act, limitation for filing an appeal is 30 days. If the petitioner files an appeal, the appellate authority will consider all the submissions made on behalf of the petitioner and will consider the grievance of the petitioner and shall decide the appeal on merit.

With these observations the writ petition is disposed of.
