Learned counsel for the petitioner submits that the petitioner was granted a fishery lease on 17.1.1996 for the period of ten years and that the period of the lease has expired on 17.1.2006 and as yet fishery lease has not been settled thereafter in favour of any person. The petitioner has filed a representation before the District Magistrate, Ghazipur on 8.2.2006 for removing the fish crop sown by the petitioner, which are said to be still lying in the Gaon Sabha pond and which the petitioner could not take out.
I have heard Sri S.K. yadav holding brief of Sri Anuj Kumar, learned counsel for the Gaon Sabha also.
It is submitted by the learned counsel for the petitioner that the petitioner will file a fresh representation in this regard before the Sub Divisional Magistrate, Jakhania, Ghazipur. In case such a representation is filed within a week from today the same shall be considered by the Sub Divisional Magistrate, Jakhania, Ghazipur in accordance with law.
With the above direction the writ petition is disposed of.
Copy of this order be made available to the learned counsel for the petitioner within a period of three days on payment of usual charges.
