Heard learned counsel for the petitioner as well as learned Standing counsel appearing for the State-respondents. Considering the nature of the order which is being passed, notices to the private respondents are not being issued. However, in case the said respondents are so aggrieved, they may file an application for recall/modification/variation of this order.
The contention of the petitioner is that challenging the election of the Gram Pradhan of the village in question, the petitioner filed an Election Petition before the Respondent no.3 on 13.8.2005. Learned counsel for the petitioner has submitted that the said election petition may be directed to be decided within a time bound period.
Considering the facts and circumstances of this case, and keeping in view that an election to a post is for a limited period and the disputes relating to such elections should be decided at an early date, this writ petition is finally disposed of with the direction that Election Petition No. 13 of 2005 Ashok Kumar vs. Sant Ram and others pending before Sub Divisional Officer, Sadar, District Muzaffarnagar, Respondentno.3, shall be heard and decided, in accordance with law, after giving opportunity of hearing to the petitioner and other concerned parties, as expeditiously as possible, preferably within a period of six months from the date of filing of a certified copy of this order.
With the aforesaid observation/direction this writ petition is disposed of. No order as to cost.
