This is an application under section  482 Cr.P.C.

I have heard Sri Sunil Kumar, learned counsel for the applicants,  and learned A.G.A. for  the State.

The learned counsel for the applicants has made only one submission before me. He submitted that the courts below may be directed to decide criminal case no. 286 of 2004 arising out of case crime no. 185 of 2003,  State Vs. Radhey Shyam alias Popi, under sections 323, 504, 506 and 308 I.P.C. of police station Gulawati district Bulandshahar pending in the court of the Chief Judicial Magistrate, Bulandshahar expeditiously, preferably within a period of two months. The learned A.G.A. has got no objection to the grant of this prayer.

The prayer of the applicants is, therefore, allowed. The Magistrate concerned  shall try to commit the  said case to the court of sessions at  the earliest, preferably within 15 days from the date of receipt of the certified copy of this order. Thereafter the Sessions Judge, Bulandhshahar  shall try to dispose of the case  at the  earliest, preferably within a period of one and half months thereafter. It shall be open to him either to hear and decide the case himself or transfer it  to any other  court for its   disposal. Stay order dated 13.9.2005  is vacated.

With these observations, the  application under section 482  Cr.P.C. is finally disposed of.
