Yash Veer Singh v. State Of U.P. And Others - WRIT - C No. 2883 of 2006 RD-AH 3630 (15 February 2006)
Hon'ble Sushil Harkauli, J.
Hon'ble Vikram Nath, J.
In view of the allegation in the impugned order that certain BPL and APL Cards did not contain any entry for the last 3-4 years, we are not inclined to entertain this petition, by bye-passing the alternative remedy available to the petitioner. Under law the petitioner has remedy of either showing cause against the suspension order/show cause notice or filing an appeal against the suspension order.
The petitioner claims to have shown cause before the concerned Authority, i.e., the respondent no. 3. If that be so, we dispose of this petition with the direction to the respondent no. 3 to decide the matter finally by a reasoned order at the earliest and if possible within six weeks of the date on which a certified copy of this order is presented before him.
Writ petition is disposed of as above.
