It is submitted by learned counsel for the applicant that at the pointing out of the applicant and other co-accused persons one stolen motor cycle has been recovered. The applicant is involved in three cases also that is why under Sections 2/3 Gangsters Act has also been added. It is contended that the applicant has been acquitted in one case and in two cases he has been released on bail. The applicant is in jail since April 2002.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Daddan Pandey involved in Case Crime No. 78 of 2002, under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act and Sections 392 and 411 I.P.C. Police Station Lar, District Deoria be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
