Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was arrested along with a sum of Rs. 400/- which were not bearing any specific mark to show that these are stolen . The applicant was involved in five other case that is why under Section 2/3 Gangsters Act has been added. The applicant has been released on bail in four cased but he has not been released on bail in one case which is out side of the State. In respect of that case the applicant was not having any proper information. The applicant is in jail since 15.06.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Devendra alias Devo involved in Case Crime No. 85 of 2005, under Sections 2/3 U.P. Gangsters and Anti Social Activities (Prevention) Act and Sections 394, 411 and 120-B I.P.C., Police Station Jamunapar, District Mathura be released on bail on his furnishing a personal bond and two sureties each of the like amount to the satisfaction of the Court concerned
