Heard learned counsel for the applicant and learned A.G.A. and also perused the material on record.
The applicant Sanua is involved in case crime No. 122 of 2005, for the offence under Section 302, I.P.C., Police Station Chharra, district Aligarh.
It is alleged that the applicant is not named in the F.I.R. However, on the next day the complainant named the applicant. The incident is of night at 9.15 p.m. It was further emphasized in the statement under Sectiion 161 Cr.P.C. the complainant has assigned the role of catching hold to the applicant and the role of firing has been assigned co-accused Pyare Khan alias Pyare Mian who has already been enlarged on bail vide this Court's order dated 2.12.2005 in criminal Misc. Bail Application No. 21569 of 2005 as mentioned in para 16 of the affidavit.
The bail is, however, opposed by the learned A.G.A.
In the circumstances, case of the applicant appears to be on better footing. He is, therefore, entitled for bail. Without prejudice to the merits of the case, I find it to be a fit case for granting bail. Let the applicant be enlarged on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the concerned Court.
