Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant was not apprehended from the spot. The allegation against him is that from his hour 65 kg beef and a dead body of cow and 8 cows were recovered. The recovery was not supported by any public witness. It was planted by taking from a slaughter house which situated near the house of the applicant. The applicant is in jail since 14.12.2005.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Shabir involved in Case Crime No. 682 of 2005, under Sections 3,5,8, U.P. Prevention of Cow Slaughter Act 1955 and Section 153-A I.P.C. and Sections 3(1)(12) of the S.C./S.T.(P.A.) Act, Police Station Kotwali, District Hamirpur be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
