HIGH COURT OF JUDICATURE OF ALLAHABAD

COURT NO. 34

CIVIL MISC. WRIT PETITION NO. 8992 OF 2006

Smt Shanti Devi       -------------    Petitioner

  Versus.

Superintending Engineer,

Rural Engineering Service Division,

Gorakhpur & Ors.        -------------  Respondents

_________

Hon'ble Dr. B.S. Chauhan, J.

Hon'ble  Dilip Gupta, J.

This writ petition has been filed  for issuing directions to the respondent authorities to construct the road from Village Koindi Bujurg to Bariyarpur, as per the earlier proposal, and not as per the revised proposal.

The facts and circumstances giving rise to this case are that a proposal was made under the Prime Minister Gramin Sadak Yojna on 13.12.2005, wherein it was decided to have a road constructed from Bariyarpur to Chakhani Khas, the village of the petitioner. However, as the said proposal had been revised and as in the new proposal, the name of the petitioner's village does not exist, the present petition has been filed for issuing directions to the respondents to construct the road under the said scheme from village Koindi Bujurg to Bariyarpur, as it is the policy decision taken by the respondent authorities. As revision  of the policy decision is permissible, we are not inclined to interfere in the matter, nor it is for the writ court to decide which road is to be constructed first.

In view of the above, we do not find any force in the petition. It is accordingly dismissed.
