Learned Standing Counsel takes notice on behalf of respondent nos. 1 and 3, Shri K.C. Sinha, learned Assistant Solicitor General for respondent no.2 and Shri Saral Srivastava for respondent no.4. Petitioner may serve a copy of the writ petition upon Shri Satendra Nath Srivastava who appears for respondent no.5.
Shri Saral Srivastava, learned counsel appearing for respondent no.4 may file counter affidavit within a period of two weeks.
In the facts and circumstances of the case, we direct the respondent no.1, District Magistrate, Basti to file his personal affidavit as under what circumstances and under what authority of law, he has granted the conditional No Objection Certificate to establish the petrol pump in anticipation of getting the approval/no objection from the authority concerned.
List the matter after two weeks.
Till then, status quo as on today, shall be maintained.
A copy of this order may be given to the learned Standing Counsel by today itself.
