Vijay Kumar Seth And Another v. Rahmat Ullah Khan And Others - WRIT - C No. 9729 of 2006 [2006] RD-AH 3771 (16 February 2006)
|
HON'BLE UMESHWAR PANDEY, J.
Heard Sri R.K. Jain, learned Senior Advocate, appearing for the petitioners.
Learned counsel for the respondent has raised preliminary objection that two orders passed on two different issues have been made subject of challenge in this petition. Instead of one the petitioners should have filed two petitions. Sri Jain submits that he shall pay the second court fees on this petition itself and that will solve the purpose. The petitioner may make the deficiency as per the aforesaid requirement good within 24 hours.
The learned counsel for the respondents requests that he may be given a week's time and no more for filing the counter affidavit. Sri Jain requests for two weeks' time to file rejoinder affidavit thereafter. The requests are granted.
List thereafter on 24.3.2006.
