Ashtbuja Prasad v. Rajendra Prasad Tiwari And Others - WRIT - C No. 9973 of 2006 RD-AH 3783 (17 February 2006)
Civil Misc. Writ Petition No. 9973 of 2006
Hon'ble Sushil Harkauli J.
Hon'ble Vikram Nath, J.
It appears that the proceedings of Suit No. 150 of 1980 were held up because of an interim order passed by the Appellate/Revisional Court. Subsequently, an amendment was sought by the plaintiff. The dates are being fixed for filing of the additional written statement necessitated by the amendment and for framing of additional issues. However, from the copy of the order sheet enclosed with this writ petition as annexure-5, it appears that on the last five dates, the additional written statement has not been filed and the defendants are seeking adjournments which are being allowed.
Considering the fact that the Suit is of 1980 and the old cases are to be given priority as also the fact that the defendants are seeking repeated adjournment instead of filing the additional written statement, we dispose of this writ petition requiring the Trial Court to proceed with the disposal of the Suit expeditiously, unless there is some legal impediment, without granting undue or unduly long adjournments in the matter.
