Sahab Dayal & Another v. State Of U.P. & Others - WRIT - C No. 9882 of 2006 [2006] RD-AH 3848 (17 February 2006)
|
Hon'ble Janardan Sahai, J.
It is submitted by Sri B. Ram, learned counsel for the petitioners that against the order dated 26.8.2002 of the Additional Collector, Ghazipur impugned in this petition a revision has also been filed by the petitioners, which is pending before the Additional commissioner, Varanasi Division, Varanasi and in the said revision an application for stay has also been filed by the petitioners but no order has been passed on the stay application and the revision itself is also not being disposed of. It is stated by the counsel for the petitioners that all the parties are represented in the revision. As the petitioners have filed a revision against the impugned order it is not a fit case for interference under Article 226 of the Constitution of India.
Having heard the counsel for the petitioners and the learned Standing counsel the writ petition is disposed of with a direction to the Additional Commissioner, Varanasi Division, Varanasi to dispose of the stay application if possible within a period of one month from the date a certified copy of this order is filed by the petitioners in the revisional court. It would also be open to the revisional court to dispose of the revision itself expeditiously.
