The petitioner discloses in paragraph-1 of the writ petition that he is a member of the general body of the institution in question and he seeks to challenge candidature of the respondent No.5, which is the outgoing Committee of Management.  

This Court, in the case of Shri Bhagwan Kaushik Vs. State of U.P. and others  has categorically held that individual members of the society can not be permitted to raise disputes with regard to the election of the Committee of Management.  As such, permission would no doubt result into unnecessary litigation.  

In view of the said decision, this writ petition is not maintainable.  It is dismissed as not maintainable.

Heard learned counsel for the petitioner and learned counsel for the University Smt. Sunitha Agarwal.

The petitioner states that initially he had made an option in the subject of Urdu.  Later, had shifted to the subject of sociology in postgraduate classes.  The petitioner states that he was only pursuing sociology course and he had opted out Urdu classes.  The University authorities has, however, passed an order saying that he could not have pursued both the courses simultaneously and, therefore, has set aside the admission in sociology also.  The petitioner has moved an appeal to the Vice Chancellor of the University on 23.4.05.

The Vice Chancellor is hereby directed to consider the case of the petitioner sympathetically and pass orders on his appeal dated 23.4.05 Hon'ble Bharati Sapru, J.
