Heard Sri Dharmendra Singhal, learned counsel for the petitioners, learned A.G.A. and perused the record.
It is contended by learned counsel for the petitioners that the petitioner no. 1 is the father in law of the victim who is an old man aged about 85 years while petitioner nos. 2,3, and 4 are married sister in law of the victim.
Considering the facts and circumstances of the case, we direct that the investigation in Case Crime No. 360 of 2005 under Sections 498A, 323, 506 IPC and Section 3/4 D. P. Act, P. S. Dehli Gate, Aligarh shall go on and the same shall be concluded within a period of three months from the date of presentation of the certified copy of this order but the arrest of the petitioners shall not be effected till the submission of the police report, if any, under Section 173 (2) Cr.P.C., provided the petitioners cooperate with the investigation.
The writ petition stands disposed accordingly.
