In the last few months while sitting as Company Judge I have observed that the cases of Shri Piyush Agrawal, who is substantially filing in this jurisdiction were adjourned very frequently.    On many occasions I found very difficult to proceed  under the rules of the Court.

I called for a report from the Deputy Registrar (Judl.) and found that the cases of Shri Piyush Agrawal, who is young lawyer, have been adjourned on almost 10 occasions in last six months.    A perusal of this application show that he has made request either on account of marriages in the family or to assist senior to appear in Lucknow Bench or at Uttaranchal High Court.

Learned counsel does not make any arrangement for argument during his absence.

Under Rule 15 of Chapter 6  of the Rules of the Court Hon'ble the Chief Justice may postpone the cases if he is satisfied that such postponement is necessary on account of marriage, death, illness or any other unavoidable or cogent reason.

Let this order be placed before Hon'ble the Chief Justice brining to his kind notice that the counsels are misusing the process of adjournments of cases, to advance their professional interest and causing serious inconvenience to the Court.  In the present case the work has virtually been obstructed by repeated adjournments given by learned counsel in last six months.
