Learned Standing Counsel represents all the respondents. He prays for and is granted three weeks'  time to file counter affidavit. Rejoinder affidavit may be filed within a weeks thereafter.

List on 9th February, 2006.

The order passed by the District Magistrate, Moradabad dated 27th September, 2005 fails to record sufficient reasons to comply with the procedure prescribed under the Statutory Rule-257 of the U.P. Panchayat Raj Rules before fixing the liability to the petitioner to make good loss caused to the Gram Panchayat.

In view of the aforesaid the petitioners have made out a prima facie case for grant of an interim order.

Till the next date of listing the recovery in pursuance of the order dated 27th September, 2005 shall shall remain stayed.
