Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is the husband of the deceased. The deceased received burn injuries on 17.7.2005. Its F.I.R. was lodged on 21.7.2005. According to prosecution version the marriage of the deceased was solemnized before 6 years back of the alleged offence. The deceased was issuless. She had received injuries. She was taken to the hospital and medical aid was provided by the applicant. The statement of the deceased was recorded in which she stated that she committed suicide by putting her on fire at the saying of the applicant. It is contended that the marriage of the deceased was solemnized about 10 years back and no offence punishable under Section 304-B I.P.C. is made out.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ram Lakhan involved in case crime no. 210 of 2005 under Sections 304-B and 498-A I.P.C. and Section 3/4 of the Dowry Prohibition Act P.S. Karvi Kotwali, District Chitrakoot be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
