Heard learned counsel for the applicant, the learned A.G.A. and Sri Prabodh Gaur learnd counsel for the complainant.
It is submitted by learned counsel for the applicant that the applicant is father in law of the deceased. He is old man aged about 70 years. The deceased committed suicide by hanging. The applicant is living separately as contended by the learned counsel for the complainant also. The case of the applicant is distinguishable with the case of co-accused.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Ramesh Chandra Sharma
involved in case crime no.498 of 2005 under Sections 498-A, 304-B I.P.C. and Sections ¾ Dowry Prohibition Act, P.S. Navbasta District Kanpur Nagar be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
