It is submitted by the counsel for the petitioner that the petitioner was granted an asami lease in the year 1953 before the enactment of Rule 176-A of the U.P. Zamindari Abolition & Land Reforms Rules and the asami lease of the petitioner is on year-to-year basis and not for a period of five years alone and the lease is therefore subsisting.
Standing counsel accepts notice on behalf of respondent nos. 1 to 3. Gram Sabha respondent no.4 is represented by Shri Anuj Kumar. Respondents are granted three weeks time to file counter affidavit. Petitioner will have three weeks thereafter to file rejoinder affidavit.
Until the next date of listing, the petitioner will not be dispossessed from the land in dispute in pursuance of the impugned order dated 13.1.2005 passed by respondent no.1 and order dated 31.12.2005 passed by respondent no.3.
