Learned counsel for the petitioners raised two points. Firstly, the deposit to acquire Bhumidhari rights was made on 26.8.1970, Sanad was granted on 27.8.170, but the saledeed was already executed before grant of Sanad and, secondly, contesting Opp. party filed an application for mutation after several years and the saledeed is not proved from the materials on record. He further urged that petitioners are scheduled caste and no saledeed could be executed.
Issue notice to Opp. party no.5. Petitioners shall take steps to serve this Opp. party by Registered Post within ten days.
List after service of notice.
Learned Standing Counsel as well as learned counsel for Gaon Sabha may file counter affidavit within a month.
Till next date of listing parties shall maintain status quo.
