Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that in the present case the applicant is not named in the F.I.R. Only co-accused Ravi Kumar and Rajendra Kumar named in the F.I.R., who were apprehended by the first informant and others from the spot. The name of the applicant came during the investigation. The only allegation against him is that he was also seen in the company of the deceased and there is not other evidence against the applicant. The naming of the applicant is after thought.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Yakub involved in case crime no. 1460 of 2004 under Sections 363, 366, 304 and 376(G) I.P.C., P.S. Haldaur, District Bijnor be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
