At the out set Sri Vinod Tripathi, learned counsel for the petitioner submits that the petitioner is prepared to pay the entire dues which is ought to be recovered as arrears of land revenue in some easy instalments.

Taking into consideration the entire facts and circumstances of the case, the writ petition is disposed of with the direction, as stated by Sri Vinod Tripathi, that the entire outstanding amount shall be deposited in four equal quarterly instalments. The first instalment shall be deposited on or before 30.3.2006, the second instalment shall be deposited on or before 30.6.2006, the third instalment shall be deposited on or before 30.9.2006 and the last instalment along with upto date interest which may include after issuance of the recovey notice/citation on or before 31.12.2006. The recovery proceeding pursuant to the citation dated 1.7.2005 (Annexure-5 to the writ petition) shall remain stayed provided the property attached having not alredy been put to auction, initially upto 31.3.2006 and if the petitioner deposits the first instalment, as directed above, further proceeding peruant to the citation shall remain stayed till 30.6.2006 and likewise in order to enable the petitioner to deposit the entire amount. In the event of default the order staying the recovery shall cease to have no effect and the authorities will be at liberty to proceed to recover the amount in accordance with law. This order will come into force in case the petitioner has not been granted any order from this Court earlier for the payment of the dues in question for the instalments.

With the aforesaid observations, the writ petition is disposed of.
