Issue notice to unserved respondents only by R.P.A.D returnable at an early date.
Appellant is directed to submit requisites for service within ten days from today. If requisites are submitted, as stipulated above, the office shall despatch the notices within ten days of the receipt of the requisites.
Until further orders, operation of the impugned judgement and award dated 25-11-2005 passed by Motor Accident Claims Tribunal/ Additional District Judge, Budaun in M.A.C. No.11 of 2001 (Ram Chandra Versus Shri Bharat Singh and two others) shall remain stayed provided the Appellant/s deposits entire amount of compensation (including interest) within two months from today with the concerned Tribunal.
Any amount deposited in this Court under Motor Vehicles Act shall be remitted to the concerned Tribunal within three weeks and the same shall be duly accounted for /adjusted while making the aforesaid deposit.
If the appellant/s deposits the aforesaid amount, as stipulated above, the claimant/respondent/s shall be entitled to withdraw half of the aforesaid amount without furnishing security and remaining balance amount of compensation shall be withdrawn on furnishing security (other than cash or bank guarantee).
It is made clear that in case of default in making aforesaid deposit, as stipulated above, this interim order shall stand automatically discharged without further reference to the court.
