The opposite party No.1, Kanchan Devi is daughter of the petitioner who was granted maintenance under Section 125 Cr.P.C. Against the said order a revision was filed and the same was allowed. The case was remanded back. Then the Magistrate awarded the maintenance of Rs.500/- against which revision was dismissed.
The learned counsel for the petitioner has further submitted that the opposite party No.1 Smt. Kanchan Devi is living with maternal grand father who is not a natural guardian and he is trying to keep his daughter with him. This is quite separate issue and by the impugned judgement the right to peruse the remedy available is no way effected. This maintenance amount if collected from the date of order i.e 4.10.2004, would come at about Rs.8000/-(Eight thousand) till 31.1.2006. This amount must be deposited in the court within a month from today which the opposite party No.1 shall be entitled to withdraw.
With this direction, the petition is disposed of finally.
