Heard learned counsel for the applicant and the learned A.G.A.
It is submitted by learned counsel for the applicant that the applicant is not named in the F.I.R. Information in respect of recovery of dead body was given to the police station.. After 22 days of the alleged offence the wife of the deceased stated before the I.O. under Section 161 Cr. P. C. that the applicant and other co-accused persons came at the house of the deceased and the deceased had gone in their company. On the next day his dead body was found. It is contended that such statement is after thought and there is no other evidence against the applicant.
In view of the facts and circumstances of the case and submissions made by the learned counsel for the applicant and without expressing any opinion on the merits of the case the applicant is entitled to be released on bail.
Let the applicant Liyaqat involved in case crime no. 1605 of 2005 under Sections 302 and 201 I.P.C.,P.S. Bilaspur, District Rampur be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
