Heard learned counsel for the petitioner, Shri Anurag Khanna, Shri Neeraj Tripathi for the Chancellor and learned Standing Counsel for the State and Shri Rajiv Joshi for NCTE.
The petitioner's educational institution has been granted recognition by the NCTE for running B.Ed. Course for the academic session 2004-05. Temporary affiliation had also been granted to the petitioner's institution by the Chancellor affiliating the petitioner for the said course to the Chaudhary Charan Singh University, Meerut.
The University after inspection of the University, penal had made a recommendation for permanent affiliation. The matter is pending before the Chancellor and has not been decided.
In the circumstances, we dispose of this writ petition finally requiring the Chancellor to take a decision in the matter with reasons within two months of the date on which certified copy of this order is presented before the Chancellor. It is further directed that in case the Chancellor finds some defect because of which he proposes not to grant affiliation, the defects will be pointed out to the petitioner in writing and the petitioner will be given a reasonable amount of time for rectifying those defects to the satisfaction of the Chancellor. The affiliation will not be rejected straightway without affording such opportunity to the petitioner. However, if any such defect has been pointed out by the Chancellor, a period of two months will be given which will run from the date on which it is communicated to the petitioner so that the petitioner rectifies the defect and intimates the same to the Chancellor.
Till the decision is taken by the Chancellor, the temporary affiliation granted to the petitioner will continue, but not beyond the academic session 2005-06.
