The suit No. 153 of 2003 is said to be pending before the Civil Judge (Jr.Div.), Mauranipur, Jhansi, in which the petitioner is the defendant. According to the petitioner, there is an interim injunction operating against the petitioner. The first prayer in this writ petition is totally misconceived. It would not be appropriate for this Court to pass an order conflicting with the interim injunction granted by the trial Court as this is not an appeal against the order of interim injunction.
In the circumstances, we dispose of this writ petition directing the trial Court to keep in mind the fact that an interim injunction is operating against the defendant while considering the grant of any adjournment by the plaintiff. The trial Court will also bear in mind the provisions of Order 39 Rule 4 C.P.C., as amended in Uttar Pradesh.
