Learned Standing Counsel represents all the respondents. He prays for and is granted three weeks' time to file counter affidavit. Rejoinder affidavit may be filed within a weeks thereafter.

In view of the First Information Report lodged by the District Supply Officer, Shahjahanpur enclosed as Annexure-4 to the writ petition, the Court is prima facie satisfied that the tanker, which was intercepted by the petitioners on 12th November, 2005 appears to be carrying unauthorized kerosene oil. Therefore, the action of the petitioners for intercepting the said tanker, prima facie cannot be said to be any misconduct.
In view of the aforesaid the petitioners have made out a prima facie case for grant of an interim order.
Till the next date of listing operation of both the orders of suspension (Annexure Nos. 1 ands 2 to the writ petition) dated 25th November, 2005, in so far as they suspend the petitioners from service, shall remain stayed. However, the proceedings initiated against the petitioners may continue and may be brought to their logical end at the earliest possible, in accordance with law.
