Ved Prakash Umrao v. Senior Supterintendent Of Police, Kanpur Nagar And Others - WRIT - C No. 10356 of 2006 RD-AH 4270 (22 February 2006)
Civil Misc. Writ Petition No. 10356 of 2006
Hon'ble Sushil Harkauli J.
Hon'ble Vikram Nath, J.
The allegation of the petitioner is that he has been allotted a government accommodation, which was earlier allotted to the respondent No. 5. The respondent No. 5 is not vacating that accommodation, thus depriving the petitioner of the accommodation allotted to him. The respondent No. 5 is a member of the police force.
In the circumstances, we direct the respondent No. 4 to look into the matter as to by what authority the respondent No. 5 is continuing to occupy the accommodation which has now been alloted to the petitioner and to take appropriate action as may be considered necessary in the matter to ensure that members of police force do not violate the law. Before taking any decision in the matter, the respondent No. 4 will give an opportunity of hearing to the respondent No. 5. The decision will be taken by the respondent No. 4 within two months of the date on which certified copy of this order along with a self-attested copy of this writ petition is presented before the respondent No. 4 by the petitioner.
The writ petition is disposed of as above.
