We have heard the learned counsel for the petitioner and Sri Ramesh Upadhyaya, learned counsel appearing for the respondents.
This writ petition has been filed for the same relief for which the earlier writ petition had been filed. By the earlier order, this Court refused to entertain the petition and directed the petitioner to file an Appeal under Section 27 of the U.P. Urban Planning and Development Act, 1973. The Appeal has been filed by the petitioner. We are, therefore, not inclined to entertain this petition.
However, in the facts and circumstances of the case, we dispose of this petition with a direction to the Appellate Authority-respondent No.1 to consider and dispose of the Appeal filed by the petitioner expeditiously and in case it is not possible for paucity of time, respondent No.1 may consider and dispose of the application for interim relief as early as possible.
