Admittedly against the order impugned in the present writ petition statutory alternative remedy by way of Appeal under Rule 20 of the U.P. Police Officers of Subordinate Ranks (Punishment and Appeal) Rules, 1991 is provided for.
Writ petition is accordingly dismissed on the ground of availability of statutory alternative remedy.
However, in the facts and circumstances of the case it is provided that if the petitioner files an Appeal under Rule 20 of the U.P. Police Officers of Subordinate Ranks (Punishment and Appeal) Rules, 1991 before the Appellate Authority along with an interim protection application within two weeks along with a certified copy of this order. The Appellate Authority shall endeavour to consider and decide the same without raising any objection with regard to delay in filing of the same, in accordance with law by means of a reasoned speaking order, preferably within six weeks from the date the Appeal along with such application is filed.
