Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the applicant was armed with rifle and other co-accused persons were armed with country made pistols. It is said that all the five accused persons discharged the shots. Consequently, the deceased received injuries. According to the post mortem report the deceased has received only one gun shot wound of entry. It has not been specified as to whose shot hit the deceased. Co-accused Ravi Kumar has been released on bail by this court on 19.12.2005 in criminal misc bail application NO. 22486 of 2005. The case of the applicant is on the same footing with the case of the above mentioned co-accused.. So the applicant is also entitle for bail on the ground of parity. .
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Brajesh Kumar involved in Case Crime No. 151 of 2005, under Sections 147, 148, 149, 307, 379, 302,504, 506 I.P.C. and 7 Criminal Law Amendment Act Police Station Sirsaganj, District Firozabad be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
