In compliance of the order passed by this Court in earlier writ petition filed by the petitioner being writ petition no. 15325/04 decided on 9.3.2005, representation made by the petitioner dated 4.4.2005 has been rejected under orders of the District Magistrate, Kanpur Dehat, after recording a finding that the petitioner had enclosed a forged certificate in his earlier writ petition filed before this Court.
It is further been recorded that the petitioner has already attained the age of 50 years and has, therefore, become over age for being sent for training.
In paragraph 19 of the writ petition it has been stated that the experience certificate filed by the petitioner is genuine. With regards to the disqualification attributed because of the age it has been stated that the respondent has to prove the same. The affidavit filed by the petitioner discloses his age as 50 years.
In view of the aforesaid this writ petition which raises disputed question of facts cannot be a subject matter of consideration under Article 226 of the Constitution of India.
Writ petition is dismissed.
