This writ petition has been filed  against the impugned order dated 20th July, 1989 and for quashing the resolution of the Committee of Management dated 29th May, 1988 and approved by the learned Vice Chancellor of the Agra University on 26th July, 1988 and consequential order of dismissal from service dated 27.7.1988. Petitioner had been working throughout this period by virtue of the interim order passed by this Court.

We have heard this matter at length, and considering the fact that petitioner had been working under the order of this Court since long, we had requested Shri Vishnu Sahai, learned counsel appearing for respondent to use his good office to settle the matter amicably outside the Court.

We record our appreciation to the service rendered by Shri Sahai that by his persuasion the said order of dismissal of the petitioner has been recalled by the Committee of Management. Today the said order has been served upon the petitioner himself.

In view of the statement made by Shri Prakash Padia, learned counsel appearing for the petitioner, who has received the order of Committee of Management, and in the facts and circumstances of the case, the petition has become infructuous and the orders passed earlier, including the resolution of the Committee of Management dated 29.5.1988 have been revoked, therefore all the consequential orders, including of the learned Vice Chancellor, become meaningless.

The petition is dismissed as having become infructuous.
