Heard learned Counsel for the applicant and learned A.G.A.
It is submitted by learned counsel for the applicant that according to prosecution version the alleged occurrence had taken place in the night of 27/28-8-05 at about 1.00 a.m. out side the village abadi near the road side. It is for away from the house of first informant. The F.I.R. has been lodged by the wife of the deceased. The deceased has received only one wound of entry. The presence of the first informant and other witnesses at the place of the occurrence is highly improbable.
After considering the facts and circumstances of the case and the submissions made by the learned counsel for the applicant and without entering into the merits of the case, the applicant is entitled to be released on bail.
Let the applicant Har Nandan involved in Case Crime No. 195 of 2005, under Sections 302 I.P.C. , Police Station Shergarh, District Bareilly be released on bail on his furnishing a personal bond and two heavy sureties each of the like amount to the satisfaction of the Court concerned.
